On 19 November 2020, the Constitutional Court declared section 1(xix)(v) of the Compensation for Occupational Injuries and Diseases Act 130 of 1993 invalid, with immediate and retrospective effect to 27 April 1994. The DoL legislated changes on the 10th March 2020 (gazette 44250) informing all domestic employers of the implication of the judgment. The change to the COID Act require all employers of domestic workers to register with the Compensation Fund effective immediately of face penalties or criminal charges.
IMPLICATION FOR DOMESTIC EMPLOYERS
This is to inform the domestic employers that based on the Constitutional Court Order dated 19 November 2020, domestic employees are now covered under the Compensation for Occupational Injuries and Diseases Act (COIDA). This means that Domestic employees will now be entitled for compensation in the event they are injured or contract diseases while on duty and employers are required to register with the Compensation Fund. As per the COID Act, the employee is a person who has entered into or works under a contract of service or of apprenticeship or learnership, with an employer, whether the contract is express or implied, oral or in writing, and whether the remuneration is calculated by time or by work done, or is in cash or in kind. The new legislation requires all domestic employers to register with the Compensation Fund.

How much do I pay
The rate to provide cover for your domestic employees is R10.40 per R1000.00 of income per annum e.g. if you are paying R5000.00 per month your premium payable is 5 x 12 x R10.40 = R624.00. (Excludes the fee payable to COIDAonline for processing your application.)
This provides you, the employer, with injury on duty insurance cover for LESS than R2.00 a day.
Compensation benefits are calculated on a minimum income R5 855.00 per month.
